# 216.110 Purpose.

The purpose of this subpart is to establish regulations governing the take of whales from the Eastern North Pacific (ENP) gray whale (*Eschrichtius robustus*) stock by the Makah Indian Tribe and its enrolled members in accordance with the Secretary's determination to issue a waiver of the Marine Mammal Protection Act (MMPA) take moratorium pursuant to 16 U.S.C. 1371(a)(3).
