**TIME AND DATE:**

10 a.m., Thursday, July 1, 2010.

**MATTERS TO BE CONSIDERED:**

The Commission will consider and act upon the following in open session: *Secretary of Labor* v. *Wolf Run Mining Company,* Docket Nos. WEVA 2006-853, *et al.* (Issues include whether the administrative law judge erred in ruling on alleged violations of the regulatory standard requiring the use of lightning arresters in certain situations.)
