**MATTERS TO BE CONSIDERED:**

The Commission will hear oral argument in the matter *Secretary of Labor* v. *Ames Construction, Inc.,* Docket No. WEST 2009-693-M. (Issues include whether a non-production operator may be strictly liable for a violation occurring in an area which the operator allegedly controls or supervises.)
