**MATTERS TO BE CONSIDERED:**

The Commission will consider and act upon the following in open session: * Secretary of Labor* v. * Ames Construction, Inc.,* Docket No. WEST 2009-0693-M. (Issues include whether a non-production operator may be strictly liable for a violation occurring in an area which the operator allegedly controls or supervises.)
