**MATTERS TO BE CONSIDERED:**

The Commission will consider and act upon the following in closed session: *Long Branch Energy* v. *Secretary of Labor,* Docket Nos. WEVA 2009-1492-R, *et al.* (Issues include whether the judge erred in granting motions to dismiss late-filed petitions for assessment of civil penalties.).
