**MATTERS TO BE CONSIDERED:**

The Commission will hear oral argument in the matter *Secretary of Labor* v. *Wolf Run Mining Co.,* Docket No. WEVA 2007-600, et al. (Issues include whether the Administrative Law Judge erred in his negligence and unwarrantable failure analysis with regard to violations involving the failure to immediately report a mine explosion.)
