**MATTERS TO BE CONSIDERED:**

The Commission will hear oral argument in the matter *Secretary of Labor* v. *Small Mine Development,* Docket Nos. WEST 2011-1351-M, et al. (Issues include whether the Administrative Law Judge erred in concluding that a refuge must be installed during exploration or development of an ore body when the operator decides not to construct a second escapeway.)
