**MATTERS TO BE CONSIDERED:**

The Commission will consider and act upon the following in open session: *Mill Branch Coal Corp.* v. *Secretary of Labor,* Docket Nos. VA 2012-435-R *et al.* (Issues include whether the Administrative Law Judge erred in upholding an imminent danger order.)
